Terms and Conditions
By using our website & accepting and signing our quote, you acknowledge that you have read, understood, and agreed to the terms and conditions set forth below. Kevin’s Tree Service (hereafter referred to as “KTS”) is authorized to commence work, and payment will be made as specified. Estimates are valid for 30 days. Cancellation of an accepted contract after 3 business days is subject to a 25% cancellation fee.
PLEASE MAKE SURE TO FULLY READ AND UNDERSTAND ALL CLAUSES BEFORE SIGNING.
1. Terms of Payment
Unless otherwise noted, payment is due in full upon project completion. Failure to remit full payment within 5 days from receipt of the invoice will result in a 5% finance charge on the unpaid balance. If further action is required to collect payment, the customer agrees to pay all reasonable costs incurred, including attorney fees and court costs. Venue for any legal action will be Seminole County, Florida.
Accepted Payment Methods:
- Cash, Checks, Money Order or Bank checks
- Wisetack Funding (A 4% processing fee will be added for all financing transactions)
- Credit Cards including ApplePay and Google Pay (A 3% processing fee will be added for all credit card transactions)
Returned Check fee is $35.00
Failure to pay for completed work may result in the dumping or return of all debris generated by the project to the customer’s property without notice.
2. Scope of Work
The estimate includes only the work explicitly listed. Please ensure that the estimate covers all the tasks you expect to be completed. Any additional work not included in the original estimate may be added at an additional fee as determined by the crew leader and verified by KTS.
3. Insurance of Contractor
KTS warrants that it carries liability insurance for injury to persons or property and Worker’s Compensation insurance for all employees, as required by law. Certificates of coverage are available upon request.
4. Cancellation Fee
KTS requests at least 48 hours’ notice for any cancellation or rescheduling of work. If a crew is dispatched to the job site and work is canceled without proper notice, a mobilization fee of $300 will be charged.
5. Completion of Contract
KTS will make every effort to meet agreed-upon performance dates but will not be liable for delays caused by weather, labor issues, equipment problems, or other unforeseen circumstances. Such delays do not relieve the customer of their obligation to pay for completed work.
6. Tree Ownership
The customer warrants that all trees listed in the estimate are on their property or that they have received permission from the property owner for KTS to perform the specified work. The customer agrees to indemnify KTS for any costs or damages arising from mistakenly identified tree ownership.
7. Stump Grinding
Unless explicitly included in the estimate, stump grinding is not part of the quoted price.
- Stump grindings/shavings are not removed unless specified.
- Surface and subsurface roots beyond the stump are not removed unless specified.
- Stump grinding will only be performed after payment is received unless otherwise arranged.
In cases where foreign materials (e.g., rocks or metal) prevent stump grinding, the customer will be charged for time and any equipment damage.
8. Concealed Contingencies
Any additional work or equipment needed due to unknown conditions (e.g., foreign material in trees or soil) will be billed on a time-and-materials basis. KTS is not responsible for damage to underground systems (sprinklers, septic tanks, invisible fences, etc.) unless these systems are accurately marked and documented by the customer prior to the start of work.
9. Clean-Up
Clean-up includes the removal of wood, brush, and debris generated by the work, as well as raking the affected area unless otherwise specified.
10. Lawn Repair and Concrete Damage
While KTS takes precautions to minimize lawn damage, lawn repair is not included in the contract unless specified. The use of heavy equipment may result in damage to driveways, sidewalks, or pavers. KTS is not responsible for such damage. Every effort will be made to minimize the impact on these surfaces.
11. Oil Dropping
KTS will not be held responsible for oil stains on driveways or sidewalks. Although precautions are taken, oil leaks can occur.
12. Animals and Insects
Trees may house animals or insects, such as bees or squirrels. If such issues arise during the project and pose safety risks, the customer is responsible for arranging for their removal at their own expense.
13. Permits
The customer is responsible for obtaining all necessary permits. If requested, KTS can apply for permits on behalf of the customer. A non-refundable administrative fee of $100, plus the cost of the permit, will be charged.
14. Opt-In Consent for Text Messaging
By providing your phone number, you expressly consent to receive text messages (SMS) from KTS for the following purposes:
- Appointment Confirmation and Reminders: Notifications related to your scheduled appointments, including confirmations, rescheduling, or reminders.
- Invoice Payment Requests: Messages regarding outstanding invoices, payment requests, and confirmations of payments.
- Service Reviews: Requests to provide feedback or review your experience after receiving our services.
These messages may be sent using automated technology or other methods but will only be related to the above purposes.
- Message Frequency: Varies based on your interactions with KTS.
- Message & Data Rates: Standard rates may apply, depending on your mobile carrier.
- Opting Out: Reply “STOP” to any message to opt out. After opting out, you will not receive further messages unless you opt in again.
